In accordance with the Federal Law for the Protection of Data in Possession of Private Companies or Individuals (the “Law”), the company known as Hostal Señor Frog’s, S.A. de C.V. (“HOSTAL SR. FROG’S”), with registered offices in Avenida Sayil, Súpermanzana 6, manzana 5, lote 2, Piso 12, Torre Azuna Corporate, C.P. 77503 in the city of Cancún, Quintana Roo, is liable for the use and protection of your Personal Information and in that regard we hereby provide you with the following information:

Your information will be collected and treated under the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility, as set forth in the aforementioned Law.

How we use your Personal Information?

The Personal Information that we collect from you will be used for the following purposes, which are necessary for the rendering of our Services and the development of our activities:

PRIMARY PURPOSES:

In order to provide the services offered by HOSTAL SR. FROG’S, at its hostel (hereafter referred to as “Services”). For billing purposes and for Invoicing our Services. Assessment of the quality of our Services. Addressing and handling your opinions, complaints and/or suggestions. Grant discounts at the Hostel. Contact you by telephone, e-mail, mail and any other method regarding information and promotional purposes of the Company. Fill out the forms known as “Survey Pocket”. Should you not agree with the handling of your Personal Information in relation to the secondary purposes, you can let us know your refusal by means of a written notice mailed to HOSTAL SR. The refusal to the use of your Personal Information for the secondary purposes shall not be a reason for us to deny the products and services requested or contracted with us.

Should you not express your refusal to the handling of your Personal Information for the secondary purposes, we understand that you have agreed.

The period of time for the handling of Personal Information of Holders will depend on the relation they hold with HOSTAL SR. FROG’S, as well as on the obligations required by the current laws, the competent authorities and HOSTAL SR. FROG’S internal policies.

What Personal Information we collect for these purposes?

To carry out the purposes described herein this Privacy Notice, we will use the following Personal Information:

--Identification Data, such as Full Name (official photo ID), Date and Place of Birth, Age, Gender, Photograph, Landline and Mobile (private) Phone Number, Fax (private), Address (private, physical address and tax residence), the Holder’s picture when entering the premises of HOSTAL SR. FROG’S (as captured by the surveillance and security cameras), e-mail, marital status, Federal Registry of Taxpayers (RFC), Unique Population Registration Code (CURP).

--Employment Information, such as Occupation or professional activity, landline or mobile Work Phone Number, Work E-mail, Work Fax.

--Billing Information, bank reference, tax residence, RFC.

At HOSTAL SR. FROG’S we do not handle or request for sensitive Personal Information, meaning: Personal Information that affects the most intimate sphere of its Holder, or whose improper use may give rise to discrimination or pose a serious risk to its Holder. In particular, any information that may reveal aspects such as the following is deemed as sensitive: ethnic background or origin, past and current health, genetic information, religious, philosophical and moral beliefs, union affiliation, political views, sexual preference.

Who we share your information with and for what purposes?

Note that your Personal Information is disclosed, within the country, to the following individuals, companies, organizations and authorities, other than us, for the following purposes:

Recipient of the Personal Information / Purpose:

Electronic Data Base Service Provider / Electronic Surveys. Local, State and Federal Authorities, as well as various public agencies and those designated by the law.

Other Restaurants and stores of Grupo Anderson’s / Service.

Your bank / When applicable, to charge for our Services with credit card and debit card.

Which are the rights of the Holder of the Personal Information?

In accordance with the provisions of the Federal Law for the Protection of Data in Possession of Private Companies or Individuals, as of January 6, 2012 you as Holder of Personal Information will be able to exercise the rights to access, rectification, cancelation and opposition, which are known under the acronym “ARCO Rights” (as long as it is admissible by law). Likewise, the consent you have given and that is necessary for the handling of your Personal Information can be revoked at any moment, or you can limit its use or disclosure. In all cases where your request is applicable, your Personal Information will be handed over free of charge and you will only be responsible of covering any justifiable shipping expenses, costs derived from the reproduction of printed copies or other formats that may be generated as indicated by the law on that topic.

You have the right to know which of your Personal Information is stored by us, what we use it for and the terms of its use (Access). How can you revoke your consent to the use of your Personal Information?

You can revoke the consent that you may have granted for the use and handling of your Personal Information. However, it is important for you to note that not in every case will we be able to attend your request or end its use with immediate effect, since it is possible that due to a legal obligation we need to continue handling your Personal Information. The withdrawal of consent can take place at any moment without attributed retroactive effects. To begin the withdrawal process you must accurately state the consent that you wish to revoke, by means of a written notice to be sent to the address mentioned above or by e-mail to: avisodeprivacidad@andermail.com. The request, written and/or electronic, of access, rectification, cancelation or opposition, must contain and accompany the following:

The Holder’s name and address or any other request-reply communication method. The documentation supporting the identity or, when applicable, the legal representative of the Holder. The clear and precise description of the Personal Information in respect of which you are looking to exercise any of the rights aforementioned and Any other element or documentation that facilitates locating the Personal Information. For rectification requests, the Holder must state which modifications need to be made and provide the documentation that supports the request. HOSTAL SR. FROG’S will inform the Holder about the resolution within 20 working days from the date when the access, rectification, cancelation or opposition request was received, so that if applicable it becomes effective within fifteen working days after the date of response. In the case of requests of access to the Personal Information, the data delivery will proceed after the identity of the petitioner or legal representative, as the case may be, has been certified. The terms mentioned above may be extended only once for an equal period as long as the circumstances of the case justify it.

The obligation of access to the data shall be deemed to have been met once the Personal Information of the Holder is made available; or through the issuing of simple copies, electronic documents or any other means that HOSTAL SR. FROG’S provides to the Holder.

In case that the Holder requests access to the data to a person that claims to be responsible of it and turns out not to be, a notification from our part, through any of the printed mediums (inadmissibility letter) or electronic (e-mail, optical technologies, etc.), informing the Holder about this situation will suffice to fulfill the request.

HOSTAL SR. FROG’S may deny access to the Personal Information, or to perform the rectification or cancelation or reject granting the opposition to its handling, under the following circumstances:

When the petitioner is not the Holder of the Personal Information, or the legal representative is not duly accredited for this purpose. When the Personal Information of the Holder cannot be found in the data base. When the rights of a third party are infringed. When there is a legal impediment or a resolution from a competent authority which restricts access to the Personal Information or does not allow rectification, cancelation or opposition to it. When the rectification, cancelation or opposition has been performed already. The refusal referred to above may be partial, in which case HOSTAL SR. FROG’S will perform the access, rectification, cancelation or opposition required by the Holder.

In all cases above, HOSTAL SR. FROG’S must state the reasons for its resolution and communicate them to the Holder, or the legal representative if applicable, within the deadlines established for that purpose, through the same method by which the request was made, accompanied if applicable by relevant evidence.

HOSTAL SR. FROG’S will not be required to cancel the Personal Information when:

It relates to the parties of a Private, Social or Administrative Agreement, and the Personal Information is necessary for its development and fulfillment. They must be handled by provision of law. Obstructs judicial or administrative proceedings associated with tax obligations, the investigation and prosecution of criminal offenses or the update of administrative penalties Are necessary to protect the Holder’s interests protected by the law. Are necessary to carry out an act according to the public interest. Are necessary to comply with an obligation legally acquired by the Holder. If cancellation is applicable, HOSTAL SR. FROG’S will establish a lockout time with the only purpose of establishing potential liabilities in relation with its handling up to their legal or contractual limitation period, and inform the Holder or its representative about the resolution to the cancelation request, that is issued within the 20 working days period, carry out the lockout within the 15 working days period and, after the lockout period, carry out the corresponding suppression.

The lockout period will be up to the corresponding legal or contractual limitation period.

How can you limit the use or disclosure of your Personal Information?

In order for you to be able to limit the use and disclosure of your Personal Information, we offer you the following methods:

1) Your registration with the Registro Público para Evitar Publicidad, or “Public Registry to Avoid Advertising” (REPEP), which is part of the Procuraduría Federal del Consumidor, or 'Office of the Federal Prosecutor for the Consumer' (PROFECO), in order to prevent the use of your Personal Information to receive advertising and promotions from goods and Service businesses. 2) Your registration in the list of exclusion “HOSTAL SR. FROG’S EXCLUSION LIST”, in order to prevent your Personal Information from being used for marketing purposes, advertising or commercial research from our part. This Privacy Notice may be subject to modifications, changes or updates derived from new legal requirements; our own needs related to the products or Services that we offer; our privacy practices or changes in our business model, or for other reasons.

We therefore reserve the right to change this Privacy Notice at any moment at its managers’ discretion.
